Guardian Contract

Guardian Agreement Terms

Please be certain that you are ready for the time, commitment, financial and emotional responsibility of a Yorkshire Terrier or Miniature Schnauzer prior to being a guardian! A Yorkshire Terrier or Miniature Schnauzer IS A LIFETIME COMMITMENT. Our guardianship program is a no-fee program if the following conditions are met.

As a guardian you agree all AKC documentation and ownership of the Yorkshire Terrier or Miniature Schnauzer will remain in the name of Tiny Tushy Lodge and its owner, Sylvia Kenworthy.
As a guardian you agree to caring for the Yorkshire Terrier or Miniature Schnauzer for __ breeding/pregnancies for Tiny Tushy Lodge. At the end of the guardianship, you agree to take ownership of the Yorkshire Terrier or Miniature Schnauzer in your change, for the rest of its life.
At the end of the guardianship you agree to not breed the Yorkshire Terrier or Miniature Schnauzer.
As a guardian you agree to care for the Yorkshire Terrier or Miniature Schnauzer in your home, for Tiny Tushy Lodge.
As a guardian you agree to take responsibility for the care and well-being of the Yorkshire Terrier or Miniature Schnauzer including proper nutritional concern and infestation care to include heartworm, flea and tick preventative medicine.
As a guardian you agree to keep the Yorkshire Terrier or Miniature Schnauzer in your charge up to date on all vaccinations.
As a guardian you agree to know the heat cycle of the Yorkshire Terrier or Miniature Schnauzer in your charge.
As a guardian you agree to keep Tiny Tushy Lodge informed of the heat cycle of the Yorkshire Terrier or Miniature Schnauzer in your charge.
As a guardian you agree to bring the Yorkshire Terrier or Miniature Schnauzer in your charge, to Tiny Tushy Lodge for 2 breeding sessions during the optimal time of the heat cycle, for breeding.
As a guardian you agree to keep Tiny Tushy Lodge informed of the pregnancy or the Yorkshire Terrier or Miniature Schnauzer in your change. (Pregnancy is approximately 9 weeks)
As a guardian you agree to bring the Yorkshire Terrier or Miniature Schnauzer in your charge, to Tiny Tushy Lodge prior to the birth of the puppies.
As a guardian you agree the Yorkshire Terrier or Miniature Schnauzer will stay at Tiny Tushy Lodge until the puppies are weaned. The Yorkshire Terrier or Miniature Schnauzer will return to your charge afterwards.
As a guardian you agree if the Yorkshire Terrier or Miniature Schnauzer in your charge is bred without the permission of Tiny Tushy Lodge or its owner Sylvia Kenworthy, the guardian will be subject to liquidated damages of $2000 per puppy, attorney’s fees in the amount of $5000.00, and the legal cost of bringing this action to enforce the terms of the contract.
If the guardian is found to have bred or breeding a Yorkshire Terrier or Miniature Schnauzer in their charge, the guardian agrees to surrender the Yorkshire Terrier or Miniature Schnauzer to Tiny Tushy Lodge.
As a guardian you agree if a Yorkshire Terrier or Miniature Schnauzer in your charge is EVER found to be in danger, unsafe or an unhealthy condition or environment, underfed, houses outside, tied out or chained, the guardian agrees to surrender the Yorkshire Terrier or Miniature Schnauzer to Tiny Tushy Lodge.
If for any reason the guardian is ever unable to care for the Yorkshire Terrier or Miniature Schnauzer under or after this program, the guardian agrees to surrender the Yorkshire Terrier or Miniature Schnauzer to Tiny Tushy Lodge.
All parties agree it is criminal conversion to rehome a Yorkshire Terrier or Miniature Schnauzer without the permission of Tiny Tushy Lodge.
If a Yorkshire Terrier or Miniature Schnauzer under or after this guardian program is found to be rehomed without the permission of Tiny Tushy Lodge the guardian will be subject to liquidated damages in the amount up $3500, attorney’s fees in the amount of $5000.00, and the legal cost of bringing this action to enforce the terms of the contract.
Ligation can and will be used to ensure the safety and well-being of a Yorkshire Terrier or Miniature Schnauzer in the guardian program, by Tiny Tushy Lodge and its owner, Sylvia Kenworthy.
