Purchase Agreement/2-Year Health Warranty
Thank you for deciding to purchase a Tiny Tushy Lodge puppy or dog. This contract is for the protection of both the breeder and the buyer - However, it is primarily to protect the health and general well-being of the puppy/dog.
Purchase Agreement
1. Please read the health warranty/agreement completely before putting a deposit on a puppy/dog. By putting a deposit on a puppy/dog, you are agreeing to the terms and conditions within this Tiny Tushy Lodge contract whether you sign it or not.
2. All puppies/dogs are sold non-breeding unless otherwise stipulated by Tiny Tushy Lodge, the seller/breeder.
3. We require a NON REFUNDABLE deposit in order to reserve the specific puppy/dog.
4. This deposit is NON REFUNDABLE. If there is a problem with the health of your puppy/dog while in the breeder’s care, the deposit will be transferred toward a comparable puppy/dog at the breeder’s selection.
5. You will forfeit your deposit and purchase if you fail to meet at a designated date/time.
Please be certain that you are ready for the time, commitment, financial and emotional responsibility of a puppy or dog prior to putting a deposit on one. A PUPPY OR DOG IS A LIFETIME COMMITMENT.
Health Warranty/Legalities
1. It will be up to Tiny Tushy Lodge, the breeder, to decide when the puppy/dog will be ready to go to its new home. Usually at the age of 8 weeks or older, depending on the being released by the vet, weight of the puppy/dog and if a puppy, how easily it is weaned from the mother. We will not, under any circumstances, let the puppy/dog leave before it is ready. There is an additional $40 a day charge for puppies/dogs kept longer than the release date delivery, if the puppy/dog is cleared for its new home.
2. The puppy/dog is warranted to be vet checked and deemed in good health at the time of sale.
3. The puppy/dog will be up to date on shots and worming at the time of delivery/pickup. As a buyer you agree to continue the vaccinations and worming of a puppy/dog.
4. If purchasing a puppy, the buyer agrees the puppy will be kept indoors or an enclosed contaminate free yard only. The buyer will NOT expose the puppy to any secondary environment, exposed yard, people or other puppies or dogs that are not fully vaccinated until he/she has completed the entire vaccination schedule - around 16-20 weeks old. Violation will void the Health Warranty. Trips away from your home WILL expose your puppy to illnesses and viruses that could be life threatening.
5. The buyer, at their own expense, is required to have the puppy/dog examined by a licensed vet within 72 hours of receiving the puppy. Failure to do so will void this agreement. PLEASE SCHEDULE THIS ASAP.
6. Written documentation of the vet visit must be sent to the breeder within 7 days in order for the Health Warranty to be honored.
7. If within 72 hours, a licensed vet finds the puppy/dog to be unhealthy or unfit for sale, the puppy/dog may be returned and the deposit/balance will be transferred toward another puppy/dog or refunded - provided the puppy/dog has not been injured or neglected. The veterinarian must provide a written statement deeming the puppy/dog “unhealthy for purchase.”
8. This warranty does not cover any health issues caused by non-vaccination, neglect, unprotected yard, exposure or injury from the buyer.
9. This warranty does not include illnesses and health issues such as colds, kennel cough, allergies, internal or external parasites or umbilical hernias. This warranty does not include entropion. However, the breeder will disclose any known condition or issues prior to the sale.
10. The breeder cannot assume responsibility for this puppy/dog after the sale. It is the responsibility of the buyer to care for the puppy/dog properly and keep it free from harm and well fed. Please remember that your puppy/dog must be treated with great care and protected from danger.
11. The breeder gives a 2 year Health Warranty against any congenital defects of a puppy/dog. If this should occur then the puppy/dog will be returned to the breeder, and the buyer will receive another puppy/dog at the breeder’s selection. The breeder’s vet must conclude the puppy/dog has a congenital defect. (NOTE: retired dogs are on a case by case situation.)
12. If the buyer chooses to keep the puppy/dog with a congenital defect, the buyer will spay/neuter the puppy/dog with proof to the breeder and surrender any registration papers to the breeder.
13. If the buyer chooses to keep the puppy/dog with a congenital defect, the breeder will be held harmless and not responsible for any medical bills.
14. The breeder assumes no responsibility for any medical expenses incurred after the sale.
15. The breeder assumes no responsibility for training difficulties or behavior problems after the sale. The breeder agrees to give support tips in training and behavior problems.
16. The breeder does not guarantee size if purchasing a puppy. We can give the buyer the weight & size of the puppy’s parents. We can give an educated guess, but there are too many variables besides genetics to determine size.
17. The puppy/dog is strictly sold as a quality pet with no breeding rights unless otherwise contractually agreed upon.
18. If a puppy/dog is bred without the permission of the buyer will be subject to liquidated damages of $2000 per puppy, attorney’s fees in the amount of $2000.00, and the legal cost of bringing this action to enforce the terms of the contract.
19. If the buyer is found to have bred or bred a dog sold under this non-breeding contract, the buyer agrees to surrender the dog to the owner of Tiny Tushy Lodge with no refund.
20. The buyer is responsible for the care and well-being of the puppy/dog including proper nutritional concern and infestation care to include heartworm, flea and tick preventative medicine.
21. If a puppy/dog sold is EVER found to be in danger, unsafe or an unhealthy condition or environment, underfed, tied out or chained, the buyer agrees to surrender the puppy/dog to Tiny Tushy Lodge with no refund.
22. If for any reason the buyer is ever unable to keep the puppy/dog, the buyer agrees to surrender the puppy/dog to Tiny Tushy Lodge with no refund and NOT place the puppy/dog in another home/shelter/environment unless given permission by the breeder.
23. All parties agree it is criminal conversion to re-homed a puppy/dog without the permission of Tiny Tushy Lodge.
24. If the puppy/dog is returned within the first 30 days, half of the purchase price will be refunded after the puppy/dog has been placed in his/her new home. The other half will cover the cost of re-homing and keeping the puppy/dog current on vaccinations and worming until the puppy/dog is placed in his/her new home.
25. If the puppy/dog is returned after the 30 days no money will be refunded.
26. If a puppy/dog is found to be rehomed without the permission of the buyer will be subject to liquidated damages in the amount up to $2000, attorney’s fees in the amount of $2000.00, and the legal cost of bringing this action to enforce the terms of the contract.
27. Ligation can and will be used to ensure the safety and well-being of a puppy/dog sold by Tiny Tushy Lodge.
